Anthony Sammons, a partner in Dinsmore’s Lexington office, was recently featured in
The Voice, published by the Defense Research Institute, for successfully defending American Express and HealthExtras. The case involved the plaintiff, an American Express card member, who purchased Accidental Disability Plan coverage from American Express, a plan marketed by American Express and HealthExtras that included a $1.5 million disability benefit underwritten by Federal Insurance Company. The plaintiff subsequently filed a claim for the benefit, asserting he had been injured after slipping on ice. After the district court eventually bifurcated the plaintiff’s contract and bad faith claims, American Express and HealthExtras moved and obtained summary judgment on the breach of contract claim for lack of privity.
