Mine Operator Strategies to Prevent or Mitigate MSHA Elevated Enforcement

This presentation provided Mine Operators and Contractors, their management and safety personnel with the knowledge and tools to effectively prepare for and avoid MSHA elevated enforcement and to develop strategies and preserve evidence to successfully defend against such enforcement actions. The presentation reviewed the various levels of elevated enforcement, including 104(d) unwarrantable failure violations, flagrant assessment violations, 107(a) imminent danger orders, 104(b) failure to abate orders, among others, and the legal elements of and defenses to such actions.
