Brohm v. JH Properties
Our firm represented Defendant Jewish Hospital and St. Mary's HealthCare, Inc. in a suit by an employee alleging discrimination and violation of the FMLA. The lower court determined that the Plaintiff anesthesiologist was not discriminated against for a disability when the hospital fired him for sleeping during surgical procedures. Further, there was no violation of the FMLA because the employee never requested leave during the time of his employment. Summary judgment was affirmed by the U.S. Court of Appeals for the Sixth Circuit.
