Jury returns significantly reduced judgment in property damage case
The case involved property damage related to a tree on our client’s property falling onto a house in Logan, West Virginia and causing extensive damage. The property owners put on evidence that supported a jury demand in property damage. The non-presiding judge in the county also testified as a witness for the plaintiffs, who were his neighbors. After a three-day trial the jury returned with a verdict for far less than the final settlement request from plaintiff before trial.
