Dinsmore's Trademarks Practice Group includes attorneys who are experienced in a full range of trademark and copyright matters on both the domestic and international level. These attorneys have a broad range of experience including: searching and clearance, prosecution, opposition/cancellation proceedings, maintenance, counseling, licensing and litigation. Their practice involves issues relating to trademarks, servicemarks, tradenames, trade dress, domain names, unfair competition, misappropriation and copyrights.
Maintenance
The Firm uses a state-of-the-art trademark management system from Computer Packages, Inc. The system provides for prosecution docketing of trademark applications filed in all countries as well as for maintenance docketing of trademark registrations. The system generates reports, is updated to maintain current information regarding the trademark laws in each country and automatically calculates important dates for each country.
Watch Services
We use watch services for domestic and foreign trademark offices to monitor all filings or allowances of marks that may potentially conflict with a given mark. We notify clients on a regular basis of any possible conflicts to evaluate if a cease and desist letter or other action is warranted.
Domain Names
We represent individuals and companies with respect to obtaining rights in domain names as well as enforcing trademark rights when others misappropriate domain names. Our attorneys have experience in the UDRP (Universal Dispute Resolution Proceedings) as well as cybersquatting litigation.
Licensing and Ownership Transfer
Our attorneys have experience in the licensing of trademarks and copyrights. We are also familiar with ownership transfers such as assignments and recording security interests.
Websites
We audit websites for trademark infringement, copyright infringement and potentially false and misleading statements that may give rise to a cause of action.
Audits and Due Diligence
Our attorneys have conducted audits of trademarks and copyrights for a number of clients to determine the value of the intellectual property and the need for continued maintenance. Also, our attorneys have performed due diligence on such intellectual property.
Litigation
We have significant experience in litigating infringement matters. Our attorneys have tried cases in state and federal courts throughout the country. We use litigation support already available within the office to computerize depositions and documents when necessary.
