Dinsmore & Shohl LLP is presenting a CLE seminar on Friday, December 1, 2023 that will be offered in a hybrid format including in-person attendance in Cincinnati and Columbus, Ohio and nationwide virtual attendance through a hosted and moderated online platform. 

The seminar, if approved, will include credit for Professional Conduct (2.5 hours of professional conduct) addressing the public perception of lawyers and lawyer misconduct as well as attorney professional conduct risks with technological innovations.  Additionally, the seminar will include general credit (4.0 hours) with presentations on practical policies to make AI technology work in the workplace, the U.S. Supreme Court’s power to grant “emergency rulings,” the resurgence of traditional labor and what employers need to know, and legal issues encountered by counsel as additional states legalize cannabis.

This one-hour presentation focuses on the public perception of lawyers, the separate but corresponding professional responsibility components of ethics and professionalism, lawyer discipline, lawyer impairment, fairness in the courts, interacting with self-represented litigants, and pro bono representation.

Professional Conduct: 
AI, Alexa, Drones, and Phones – Modern Trends in Legal Ethics in an Era of Technological Innovation 

(1.5 - hours professional conduct credit)
This panel presentation will discuss how technological change has touched every facet of the practice of law and is seemingly accelerating at every turn.  New technologies such as artificial intelligence (AI), drones, Zoom, and smartphones offer practicing attorneys many potential opportunities to streamline their practices, but also offer many pitfalls.  Panelists from Dinsmore and the Ohio Board of Professional Conduct will discuss these emerging issues, including Rules 1.1, 1.3, and 1.4 of the Rules of Professional Conduct, which outline lawyers’ responsibilities for the competent and diligent representation of clients.  In particular, ABA Model Rule 1.1, comment [8], requirement that lawyers “keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology” will be discussed.

After discussing the ethical issues involving new technology and artificial intelligence, this panel will discuss practical approaches and policies for legal departments to allow the use of generative AI programs in the workplace (e.g., ChatGPT).  This panel will include a discussion of how AI is being used by leading corporations while minimizing risks associated with those programs, particularly in the areas of intellectual property.

The Shadow Docket: What’s Really Wrong with the Supreme Court—and How To Fix It

The Supreme Court has always had the authority to issue emergency rulings in exceptional circumstances. But, since 2017, the Court has dramatically expanded its use of the behind-the-scenes “shadow docket,” regularly making decisions that affect millions of Americans without public hearings and without explanation, through cryptic late-night rulings that leave lawyers—and citizens—scrambling.  Professor Stephen Vladeck will discuss whether Americans of all political stripes should be worried about what the shadow docket portends for the rule of law.

Unions on the Rise, Stricter Rules for All Employers, and Other Labor Law Updates You Need to Know

Traditional labor is making a resurgence!  Employees in a variety of business sectors are considering whether organized labor movements can achieve progressive goals.  This panel will provide a brief look at the statistics and primary reasons for traditional labor’s resurgence and how “Right to Work” laws impact the workplace.  Panelists will explain recent National Labor Relations Board (NLRB) changes that have made labor organizing easier and other ways that companies become unionized.  Finally, the panelists will discuss legal issues presented by strikes and how companies can avoid union organization.

Randy J. Curato

Vice President—Senior Loss Prevention Counsel counsels and educates lawyers on ethics, professional responsibility, and avoiding malpractice.  He is a regular speaker at outside conferences and programs on ethics and professional responsibility.  Prior to joining ALAS, Randy was a Partner at Bell, Boyd & Lloyd LLP in Chicago for 18 years. While at Bell Boyd, he handled litigation, arbitration, and trials of commercial, real estate, environmental, probate, product liability, professional malpractice, and contract cases. Randy started his practice with Wildman, Harrold, Allen & Dixon LLP in Chicago, where he handled litigation matters.  Randy is a member of the American and Chicago Bar Associations, and serves on the advisory board of the Working Group on Legal Opinions.

Prior to JLL, Mr. Tse was the Senior Vice President, General Counsel and Corporate Secretary of Petco. Prior to Petco, Mr. Tse was the Executive Vice President, General Counsel and Corporate Secretary of Churchill Downs, Inc. Tse was formerly Vice President and General Counsel of LG Electronics MobileComm U.S.A., Inc. Mr. Tse serves on the Board of Directors of the Association of Corporate Counsel and chaired its Advocacy Committee and is the co-founder and serves on the Board of the Asian American Legal Foundation. Mr. Tse was named one of the best lawyers under 40 by the National Asian Pacific American Bar Association in 2005 and was named as a Top General Counsel to Watch by NYSE’s Corporate Board Member magazine in 2012. Mr. Tse holds a B.A. in Economics and Political Science from the University of California at Berkeley where he earned Phi Beta Kappa honors and graduated cum laude from Harvard Law School.


Stephen Vladeck

Stephen Vladeck holds the Charles Alan Wright Chair in Federal Courts at the University of Texas School of Law, is currently a Visiting Professor at the University of Chicago Law School, and is a nationally recognized expert on the federal courts, constitutional law, national security law, and military justice.

Vladeck is author of the New York Times bestselling book, "The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic." He has argued over a dozen cases before the U.S. Supreme Court, the Texas Supreme Court, and various lower federal civilian and military courts; has testified before numerous congressional committees, Executive Branch agencies, and the Texas legislature; has served as an expert witness both in U.S. state and federal courts and in foreign tribunals; and has received numerous awards for his influential and widely cited legal scholarship, his prolific popular writing, his teaching, and his service to the legal profession.

Vladeck is the co-host, together with Professor Bobby Chesney, of the popular and award-winning “National Security Law Podcast.” He is CNN’s Supreme Court analyst and a co-author of Aspen Publishers’ leading national security law and counterterrorism law casebooks. And he is editor and author of "One First," a popular weekly newsletter about the Supreme Court. A 2004 graduate of Yale Law School, Vladeck clerked for the Honorable Marsha S. Berzon on the U.S. Court of Appeals for the Ninth Circuit and the Honorable Rosemary Barkett on the U.S. Court of Appeals for the Eleventh Circuit.
