We have represented a host of craft breweries, distilleries, wholesalers, and distributors through the negotiation of distribution agreements for territories within Alaska, California, Colorado, Illinois, Louisiana, Massachusetts, Ohio, Pennsylvania, South Carolina, Texas, and Washington. In addition to ensuring compliance with state-specific distribution laws, our work included negotiating key terms including minimum sales volumes, mandatory marketing spends, and termination provisions favorable to the supplier-side or distributor-side, depending on the applicable client.

Lead counsel in illegal online gaming litigation

Eric Lycan served as lead counsel for the Commonwealth of Kentucky against 141 internet domain names associated with illegal online gambling and their owners resulting in a judgment of over $870 million. Internet gambling is illegal under Kentucky law and Mr. Lycan brought suit against the domain names in a groundbreaking civil in rem forfeiture action. The United States Department of Justice subsequently followed with a suit of its own employing the same legal theories under federal law. In addition to the in rem action, Mr. Lycan brought a related case against the owners of,, and other illegal online gambling operations.

Eric Lycan serves as counsel to numerous PACs and nonprofits. He advises regarding the attributes and advantages of different advocacy entities or combinations, the formation of the entities, and compliance with federal law and the many different state regulatory schemes. Notable clients include:

Counsel to U.S. Senator Majority Leader Mitch McConnell’s Campaign

Eric Lycan was counsel for the campaign’s election integrity and GOTV efforts. He prepared the campaign’s litigation strategy and advised regarding Kentucky elections laws. He organized, trained and oversaw a state-wide team of lawyers to ensure that every legal vote was counted, coordinating with 121 Kentucky election authorities.

Mr. Lycan also serves in a volunteer capacity as the General Counsel for the Republican Party of Kentucky and sits as a member of the Republican State Central Committee, the Executive Committee, and the Budget Committee. In that capacity, he advises the party regarding campaigns, elections, and its interactions with its elected officials and candidates.
