"Plaintiff’s lawyers have found a new way to extract money from Ohio banks using website accessibility under the Americans with Disabilities Act as the basis for a claim," reported presenter Susan Zaunbrecher, a partner at OBL affiliate member Dinsmore & Shohl. "Though the final rules on website accessibility are not due to be published until 2018, there are current rules and standards that plaintiffs’ lawyers are pointing to in order to muddy the waters and make demands." "It is important that banks treat these threats seriously, and respond appropriately," emphasized co-presenter Jeff Smith, a partner at OBL Vorys, Sater, Seymour & Pease, LLP. "How an OBL member responds to these letters and how it positions itself going forward is critical to the viability of the claim and its impact on the bank." Technology consultant Paul Elder of Community Bank Consulting will also be on hand to describe testing methods, compliance checking and other web design issues. Smith and Zaunbrecher will cover legal aspects and what banks should do to protect themselves from claims and possible lawsuits.
