The current language in 30 C.F.R. Section 56/57.18002 has long guided metal/nonmetal operators in conducting workplace examinations. But, on Wednesday, July 22, 2015, the Mine Safety and Health Administration attempted — under the guise of providing guidance to the regulated community — to re-invent the workplace examination requirement in a single and swift administrative action. Program Policy Letter No. P15-IV-01 (“PPL”) language sidesteps regulatory definitions in Section 56/57.2, creates requirements not present in the current standard, and expands the scope of workplace examinations beyond current regulatory intent.
