On May 1, 2014, the Mine Safety and Health Administration (“MSHA”) will publish in the Federal Register its final rule to lower miners’ exposure to respirable coal mine dust. Slated to go into effect on August 1, the new rule will be phased in four parts and have a major impact on the mining industry. As part of this rollout operators will be required to adopt new measures and procedures for dust sampling, record keeping, and medical surveillance.
