Same Story, Different Day: The Attorney’s Perspective on the EEOC and FCRA
The EEOC continues to be a hot topic in the headlines, most recently for their separate lawsuits against BMW and Dollar General. In both cases, the EEOC alleges the employers' use of "bright-line" criminal background checks in the hiring process violates part of the 1964 Civil Rights Act. The lawsuits are the first enforcement action against employers under the revised EEOC Enforcement Guidance that was released April 25, 2012.
