Breach of Contract
When an investment company entered into a dispute with its broker dealer, they enlisted the help of Dinsmore. Our client alleged that its broker dealer had breached their contract by not issuing full payments of all commissions on trades involving municipal bonds. Working closely with the client, we conducted a thorough analysis of the trades over the course of the parties’ relationship to verify our client’s claims and determine the amount of payments owed to them. We tried our case before the American Arbitration Association, which awarded our client the entirety of the commissions it claimed it was owed. We then obtained confirmation of the arbitration award in the U.S. District Court for the Northern District of Northern California. The respondents appealed the confirmation ruling to the Ninth Circuit Court of Appeals, and prior to the appeal being heard, we reached a settlement for payment of the entirety of the commissions, as well as attorney’s fees.
