Cumulative trauma claim results in defense verdict

The case involved a cumulative trauma claim by a plaintiff regarding the work practices of mounting and dismounting moving equipment and walking on uneven and over-sized ballast during his 40 year career with our client, a national transportation company. The plaintiff was a very well known individual in Breathitt County, his wife had a long career as a teacher at the local high school and his brother had just been re-elected as the PVA. The plaintiff introduced evidence that he would need knee replacement surgery and requested a large sum in closing argument. After a three-day trial we received a defense verdict.
