Post trial motions lead to settlement within client’s evaluation of FELA case

Our client, a national transportation company, was sued by the plaintiff for a cumulative trauma, upper extremity claim regarding several different work activities. The plaintiff had undergone several upper extremity operations before trial and claimed additional operations would be needed after the trial. The trial resulted in a verdict for the plaintiff. However, based upon post-trial motions we prepared, the plaintiff accepted less to end the litigation. This was an amount within our client’s settlement evaluation of the case.
