Supreme Court Clears the Path for False Advertising Suit against Coca-Cola
On June 12, 2014, the U.S. Supreme Court reversed the Ninth Circuit’s ruling, finding that U.S. Food and Drug Administration rules can co-exist with the federal false advertising statute. The 8-0 decision in POM Wonderful LLC v. The Coca Cola Company paved the way for Pom’s Lanham Act suit against Coke to move forward.
