Brian spoke at the International Council of Shopping Centers (ICSC) U.S. Shopping Center Law Conference on the topic: “Backfilling Large Vacant Spaces in Shopping Centers.” His session covered key issues that must be resolved in order to successfully backfill big box vacancies with new, non-traditional retail concepts in the current retail market. Topics included redevelopment strategies, co-tenancy issues, exclusives, construction restrictions, parking requirements, and other limitations in existing leases and/or REAs and CC&Rs, as well as restrictive covenant agreements, third party approval agreements, and joint venture agreements.
