Harris is a complex commercial litigator with experience representing a wide range of clients, including technology companies, consumer goods manufacturers, importers, and sellers, construction companies, financial institutions, small businesses, Fortune 500 companies, fashion brands, jewelry brands, and hotel chains.  Harris also has extensive experience representing real estate entities, including commercial and residential landlords, developers, real estate investors, REITs, property managers, commercial leaseholders, joint ventures, and condo boards. 

Harris practices both plaintiff and defense-side litigation in federal courts, state courts, and arbitral bodies and routinely advises his clients on business disputes, corporate dissolutions, and matters of regulatory compliance.  As a sophisticated negotiator, Harris works towards mitigating and eliminating his clients’ exposure by achieving successful early resolutions.

When litigation is unavoidable, Harris brings to bear his formidable skills as a trial attorney to put his clients in favorable positions to win.  Harris has first or second-chaired 20 jury trials and 23 bench trials. He has also taken and defended over 100 depositions, including depositions of expert witnesses.

Harris also represents his clients in the negotiating and drafting of arms-length business contracts, such as commercial leases, purchase and sale agreements, licensing and access agreements, joint venture agreements, and financing agreements. 

Prior to moving to Louisville with his wife, Harris worked in New York as a commercial litigator at New York’s premier real estate law firm and at an AmLaw 100 firm.  Following law school, Harris was a prosecutor at the Miami Dade State Attorneys’ Office.

  • Successful Transactional representation and cases

    • Successfully represented numerous commercial property owners in the negotiation of both licensor-side and licensee-side access agreements for Local Law 11 work and construction work.
    • Successfully represented numerous commercial landlords in leasing negotiations with new and existing office and retail tenants.
    • Negotiated and drafted purchase and sale agreements and construction contracts on behalf of commercial developers and construction companies.
    • Successfully advised a commercial developer regarding an inquiry by the United States Department of Labor.
  • Successful Commercial Litigation representation and cases

    • Successfully represented a non-profit organization and its principals in connection with a federal civil RICO action in the US District Court for the Eastern District of New York.
    • Successfully negotiated over 35 favorable settlement agreements in products liability and breach of warranty actions.
    • Advised an unsecured-creditor in Bankruptcy Court, drafted a proof of claim, and negotiated with the bankruptcy trustee.
    • Researched and drafted a motion to dismiss in a multi-million-dollar fraudulent misrepresentation class action in California federal court.
    • Researched and drafted an appellate brief on behalf of a distributer of consumer goods in a deceptive practices action in Wisconsin state court.
  • Successful Real Estate Litigation representation and cases

    • Represented numerous commercial landlords in connection with COVID-19 breach of lease disputes and actions against retail and office tenants and obtained multiple million-dollar judgment and settlements on behalf of clients.
    • Represented a real estate investor in connection with an action for breach of a triple-net ground lease brought by the developer-lessee, and deposed the lessee’s project manager.
    • Represented a warehouse owner and a 1031 qualified intermediary in connection with an action for specific performance and breach of the purchase and sale agreement brought by the property’s intended purchaser.
    • Defended a public-private joint venture development in obtaining the dismissal of a mechanics’ lien foreclosure action brought by the general contractor of the client’s commercial tenant.
    • Represented a large non-profit housing developer-provider in connection with a defective construction action against its former general contractor.
