Dinsmore labor partner Mark Carter discussed with Law360 the pacing of the National Labor Relations Board’s expected shift of precedent on numerous labor law matters, including reversing decisions the prior Republican majority put forth. An excerpt is below.

Given that six months have already passed since the Democratic majority took over, Carter said any further delay means it will have less time to issue other precedent-shifting decisions, especially if Republicans are successful at the ballot box.

"There is no doubt there's a dramatic difference between three years and four years in terms of making a significant imprint upon the interpretation and application of the [National Labor Relations Act]," Carter said.
