Biography
Zach represents businesses, financial institutions and individuals in a wide range of commercial disputes, with a particular focus on creditors’ rights and complex financial litigation. He advises debt purchasing companies, alternative investment businesses, and lending institutions, including banks, credit unions and private finance companies, on debt restructuring, collection and lien enforcement strategies, and security interest perfection and priority issues under UCC Article 9. His work also encompasses breach of contract and general business litigation; pursuing officer and director liability, malfeasance, and veil piercing claims; credit default litigation; and mortgage and lien foreclosure, writs of possession and execution, asset seizure and sales, garnishment, charging orders, and other post-judgment remedies and proceedings.
Zach represents clients in both Kentucky state and federal courts, arbitrations and mediation proceedings. His litigation experience includes forcible detainer eviction proceedings and endorsement disputes under UCC Articles 3 and 4. He frequently negotiates and finalizes settlement agreements, judgments, and forbearance arrangements tailored to each client’s needs. With his ability to distill technical legal and financial concepts into clear, persuasive arguments, Zach can resolve lawsuits for his clients early through motion practice or negotiated settlements.
His bankruptcy practice includes representing creditors in Chapters 7, 11, and 13 cases. In bankruptcy court, Zach represents his clients throughout the claim filing process including claim objection proceedings. He also represents clients in discharge disputes, avoidance and preference actions and other adversary proceedings.
Zach also negotiates service contracts and drafts leases and other legal documents for consumer and commercial landlords and property management companies, and advises those businesses on legal risk management issues.
Beyond this, Zach’s experience representing clients in real estate litigation is extensive. He advises landowners, property managers, real estate professionals and community associations, helping these and other clients to manage boundary and partition actions and other real estate disputes, adverse possession claims and conflicts over title and property use.
