Nicholas P. Capotosto

Biography

Nicholas focuses his practice in Commercial Litigation where he works as a trusted counsel advising large and medium size businesses and non-profit organizations. He has litigated multi-million dollar lawsuits in matters related to large financial institutions and insurance companies. He defended a global title insurance company in a coverage dispute involving a $350 million claim alleging a break in the priority of a $1 billion insured credit line deed of trust. He has managed the defense, document production, and depositions of over 100 insurance agents served subpoenas in a multi-million dollar class action alleging violations under The Real Estate Settlement Procedures Act (RESPA.)

His experience includes acting as lead counsel on a variety of labor and employment matters including wrongful termination, workplace injuries, unemployment compensation, and workplace discrimination. He has acted as national counsel for a large consumer products manufacturer in product liability lawsuits. He has secured vital trade secrets by enforcing non-compete and non-solicitation agreements for a manufacturer of soil stabilization products, as well as financial investment firms, physician practice groups, and a local food service franchise.

He has negotiated and enforced hundreds of complex commercial agreements and litigated more than twenty matters involving temporary restraining orders and injunctive relief. 

He was an Administrative Contracting Officer with the Unites States Air Force where he was tasked with handling $3.5 billion in contracts.
